Economic security bureau. Lawyer tell the facts
The Verkhovna Rada of Ukraine adopted in the second reading and as a whole, draft law No. 3087-d “On the Bureau of Economic Security”.
So, at the same time, the tax militia was liquidated, a new law enforcement agency was created, which will take over the lion’s share of the functions of its predecessor and will deal with criminal offenses in the economic sphere.
But the BEB will not be the only body that will investigate economic crimes – NABU remains.
BEB will investigate crimes related to the economy and finance, such as, for example, tax evasion, etc.
The BEB employs detectives who, among other things, collect and process analytical information in order to identify the causes and eliminate conditions conducive to the commission of criminal offenses attributed to the Bureau’s investigative jurisdiction.
The Bureau will be able to attract qualified specialists on a contractual basis, legally for qualified work (technical as a rule).
Like other power structures of the state, the BEB will conduct operational-search activities, and will also interact with the state authorities. authorities, n.s. bodies, judicial authorities, other state. bodies, enterprises and organizations as well as with bodies of foreign states and international organizations.
BEB will also search for persons hiding from the bodies of pre-trial investigation, investigating judge, court, or evading criminal punishment for committing criminal offenses attributed by law to its jurisdiction;
The Bureau of Economic Security will be headed by a director, who is appointed by the government of the country on the proposal of the Prime Minister, who has previously received a proposal from the commission for holding a competition.
The director, in order to obtain this position, must have a higher legal education, be at least 35 years old, and must also have at least 10 years of work experience in the specialty and at least 5 years of experience in managerial positions.
Also, in order to quickly adapt legislation to a new body, Draft Law No. 3087-d proposes to amend a number of laws, the essence of which is to replace the phrase “tax police” with the “Bureau of Economic Security of Ukraine”.
